Drug Crimes
The most common drug charges are for possession for controlled substances including marijuana, methamphetamines, cocaine or heroin. In drug cases, there are serious penalties including jail time, prison, as well as forfeiture of your personal property, including your vehicle.
When I am evaluating a drug case, I pay particular attention to whether or not your Fourth Amendment rights were being protected. Did the police have a warrant? Was there sufficient probable cause to search your car, your house, or your person? You have the right to challenge these issues and make the State prove the elements of the crime and that the police acted property during and after the arrest.
Assault
I work with people charged with both domestic assault and other types of assault charges. Since assault is a crime against a person it is considered a crime of violence. If you are charged with domestic assault or assault and battery, you may be subject to a restraining order which prohibits you from interacting with the alleged victim. It is important you understand the parameters of the restraining order and do not violate the restraining order.
You will want to speak with an attorney before appearing in court. Domestic violence is an enhanceable offense in Minnesota which means if you plead guilty and you have prior or future domestic assault charges it could turn into a more serious crime resulting in jail time. If convicted of assault, you will most likely lose your right to bear firearms for the remainder of your life.
